Terms and Conditions of Use
These Terms govern access to and use of the website, application, and features offered by Arte Conecta.

1. Acceptance of the Terms
By creating an account, accessing, or using the services, the user declares that they have read, understood, and agreed to these Terms and to Arte Conecta’s Privacy Policy.
If the user does not agree with these conditions, they should not use the platform.
When the service is used on behalf of a school, company, institution, or other organization, the user declares that they have the authority and authorization to bind such organization to these Terms.
2. Registration, Eligibility, and Account
Registration and platform accounts are intended exclusively for adults aged 18 or older.
Children and adolescents may participate in the artistic activities, but the account, recording of artistic productions, and use of monitoring features must be managed by responsible adults, family members, educators, professionals, or facilitators.
The user must:

provide accurate, complete, and up-to-date information;

protect their login credentials;
-
promptly report any suspected unauthorized access;

use the account only for permitted purposes;
-
be responsible for activities carried out through their account, except where a failure attributable to Arte Conecta or third parties under its responsibility is demonstrated.
The adult user is responsible for assessing the suitability of the activities for the context, age, and needs of the children or adolescents involved, as well as for obtaining any authorizations required in their family, educational, professional, or institutional context.
3. Scope of the Service
Arte Conecta offers content, artistic proposals, activities, learning paths, educational resources, recording tools, and monitoring features related to art and the artistic-pedagogical process.
The platform may also provide Arte Observa IA, an artificial intelligence feature designed to perform an artistic-pedagogical analysis of artistic productions submitted by the adult user.
Available features may vary depending on:

the subscribed plan;
-
the device used;
-
location;
-
technical availability;
-
service updates;
-
third-party integrations.
Arte Conecta may correct, update, replace, or discontinue features, subject to applicable law and the conditions offered to users of paid plans.
4. License to Use the Platform
Arte Conecta grants the user a limited, personal, non-exclusive, non-transferable, revocable, and non-sublicensable license to access and use the platform in accordance with these Terms.
This license does not transfer to the user any ownership rights over:

the platform;

the software;
-
the code;
-
the trademarks;
-
the visual identity;
-
editorial content;
-
learning paths;
-
artistic proposals;
-
educational materials;
-
interfaces;
-
databases;
-
any other creations owned by Arte Conecta or its licensors.
Unless expressly permitted, the user may not copy, reproduce, adapt, distribute, sell, sublicense, commercially exploit, reverse engineer, or create derivative works from the platform.
5. Arte Conecta Intellectual Property
Rights relating to the Arte Conecta trademark, Arte Observa IA, software, design, texts, proposals, materials, videos, graphic resources, and other elements of the platform belong to Arte Conecta or their respective owners and licensors.
Use of the platform does not grant authorization to use Arte Conecta trademarks, names, logos, or other identity elements outside the features made available through the platform.
Any suggestions, criticism, or comments submitted by the user may be used to improve the service, without transferring to Arte Conecta any rights over artistic or personal content submitted by the user.
6. User-Submitted Content
The user retains ownership and any rights they hold over photographs, records of artistic productions, texts, responses, observations, and other content submitted to the platform.
Arte Conecta does not acquire ownership of the artistic production of the user, child, or adolescent.
To enable the service to operate, the user grants Arte Conecta a technical, non-exclusive, royalty-free license, limited to the period and purposes necessary to:

host;

store;
-
technically reproduce;
-
process;
-
analyze;
-
transmit;
-
display the content within the platform.
This license exists only to the extent necessary to provide, protect, and improve the subscribed features. It ends when the content is deleted, except for temporary copies, backups, and retention required or permitted by law.
The technical license does not authorize Arte Conecta to publish, sell, or use artistic productions in advertising, portfolios, identified research, or external communications without an appropriate legal basis and, where necessary, specific authorization.
The user declares that they have the rights, authorizations, and legal authority necessary to submit the content. The user must not submit material that is:

unlawful;
-
offensive;
-
discriminatory;
-
in violation of third-party rights;
-
unnecessarily exposes personal data;
-
contains photographs or information obtained without the required authorization.
When recording an artistic production related to a child or adolescent, the adult must avoid including the child’s or adolescent’s face, full name, address, location, school, or other identifying elements when they are not necessary for the activity.
7. Arte Observa IA and Use of Artificial Intelligence
Arte Observa IA performs an artistic-pedagogical analysis of artistic productions submitted by the adult user.
The feature may observe aspects such as:

shapes;
-
colors;
-
composition;
-
materials;
-
techniques;
-
elements of the expressive process.
Arte Observa IA may also generate artistic-pedagogical suggestions and recommend Arte Conecta proposals, activities, or learning paths.
Arte Observa IA:
-
does not provide medical, psychological, or therapeutic diagnoses;
-
is not a clinical assessment tool;
-
does not replace the observation, listening, and judgment of family members, educators, or qualified professionals;
-
does not automatically infer the emotions or emotional states of children or adolescents from an image;
-
should not be used as the sole basis for clinical, therapeutic, educational, or rights-affecting decisions.
Results generated by artificial intelligence may contain inaccuracies, omissions, or suggestions that are inappropriate for the specific context. The adult user must critically review the results before using them.
8. User Responsibilities and Conduct
The user agrees to use the service lawfully, ethically, and in accordance with these Terms.
The following are prohibited:

violating copyrights, trademarks, privacy, image rights, or other third-party rights;

sharing the account with unauthorized persons;
-
attempting to access third-party accounts, areas, or data;
-
copying, extracting, or scraping platform content or databases;
-
circumventing security measures;
-
reverse engineering, except where expressly permitted by law;
-
interfering with the operation of the service;
-
submitting viruses, malicious code, or illegal content;
-
using the service for diagnosis or clinical assessment;
-
using the platform for automated decision-making concerning children or adolescents;
-
submitting images or personal information without authorization;
-
submitting personal data in quantities greater than necessary.
9. Privacy and Data Protection
The processing of personal data related to the service is described in Arte Conecta’s Privacy Policy, which forms an integral part of these Terms.
The adult user must understand the applicable rules before submitting photographs, records, or information relating to children and adolescents.
10. Payments, Subscriptions, and Price Changes
Where a paid plan is offered, the price, billing frequency, included features, and payment conditions will be disclosed before purchase.
Payments may be processed by app stores or payment providers and will also be subject to the terms and policies of those third parties.
Arte Conecta may change plan prices or conditions for future billing periods, subject to appropriate prior notice and compliance with applicable law.
Changes will not affect amounts already paid for the subscribed period, except where required by law or expressly agreed.
11. Cancellation, Refunds, and Right of Withdrawal
The user may cancel the renewal of their subscription through the channels made available during the subscription process.
When the purchase is made through an app store or another third party, cancellation and any applicable refund may be subject to the procedures of the respective platform.
Rights of withdrawal, refunds, and reimbursements will be observed in accordance with applicable law and the characteristics of the transaction.
Cancellation of renewal does not, by itself, entitle the user to a proportional refund for a billing period that has already begun, except where:

required by law;
-
provided for in the offer;
-
expressly accepted by Arte Conecta.
12. Availability, Support, and Changes to the Service
Arte Conecta seeks to keep the service available and secure but does not guarantee uninterrupted or error-free operation.
The following may occur:

scheduled or emergency maintenance;
-
service outages;
-
connection failures;
-
device limitations;
-
issues involving third-party services;
-
events beyond Arte Conecta’s reasonable control.
Features, content, and technical requirements may be corrected, updated, replaced, or discontinued.
Where a material change affects a paid service that has already been subscribed to, Arte Conecta will adopt communication measures consistent with applicable law and the relevant offer.

13. Third-Party Services and Links
The service may contain integrations with or links to app stores, payment providers, and other third-party services.
These services are governed by their own terms and policies. Arte Conecta does not control the practices of independent third parties, without prejudice to any responsibilities assigned to Arte Conecta by law.
14. Term, Suspension, and Termination
These Terms remain in effect for as long as the user maintains an account or uses the service.
The user may request the closure of their account through the channels made available on the platform or through support.
Arte Conecta may limit, suspend, or terminate access in the event of:

violation of these Terms;

security risks;
-
fraud;
-
unlawful use;
-
failure to make payments, where applicable;
-
legal requirements;
-
discontinuation of the service.
Whenever appropriate in the circumstances, the user will receive adequate information and a reasonable opportunity to remedy the issue.
Termination does not affect obligations and rights that, by their nature, should remain applicable, including intellectual property, outstanding payments, data protection, liability, and dispute resolution.
15. Warranties and Nature of the Service
The service is provided according to its features and availability.
Arte Conecta does not guarantee specific pedagogical, educational, behavioral, clinical, or therapeutic results.
Nothing in these Terms excludes warranties, rights, or liabilities that cannot be excluded under Brazilian law, including consumer protection laws, where applicable.
16. Limitation of Liability
To the extent permitted by law, Arte Conecta will not be liable for indirect damages, loss of profits, or losses resulting from:

improper use of the service;
-
decisions made without human review;
-
use of Arte Observa IA for clinical or therapeutic purposes;
-
failures of independent third parties;
-
events beyond its reasonable control.
This limitation does not apply to willful misconduct, gross negligence, breach of mandatory legal duties, damages for which liability is mandatory, or other circumstances in which exclusion or limitation of liability is prohibited by law.
17. Indemnification
To the extent permitted by law, the user will be responsible for proven losses caused by:

violation of these Terms;
-
content submitted without the necessary rights or authorizations;
-
unlawful use of the platform;
-
violation of third-party rights.
The user will be ensured due process, the right to be heard, and appropriate determination of responsibility.
18. Assignment
Arte Conecta may assign or transfer these Terms in connection with a corporate reorganization, merger, acquisition, or transfer of the service, subject to applicable law and protection of the user’s rights.
The user may not assign their account or these Terms without Arte Conecta’s authorization, except where permitted by law.
19. Severability and Waiver
If any provision of these Terms is deemed invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted.
Failure to immediately exercise any right does not constitute a waiver and does not prevent its subsequent exercise.
20. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federative Republic of Brazil.
Any disputes may be submitted to the courts, subject to applicable jurisdiction rules and, where applicable, the courts of the consumer’s domicile.
Where a contractual choice of forum is legally valid, the courts of the Judicial District of Rio de Janeiro, State of Rio de Janeiro, are designated.
These Terms do not establish mandatory arbitration.
21. Changes to These Terms
These Terms may be updated to reflect changes that are:

operational;

commercial;

related to platform features.
The current version will indicate the date of the most recent update.
Material changes will be communicated through appropriate means, and acquired rights will be respected.
