Arte Conecta is the controller of the personal data processed within the platform, as it determines the main purposes and means of this processing.

In some situations, schools, institutions, companies, or professionals using the platform may act as independent or joint controllers, depending on the decisions they make regarding the data under their responsibility.

  • They get in touch with Arte Conecta;

  • They hire or use services offered by the platform.

Registration and accounts are intended exclusively for adults 18 years of age or older.

Children and teenagers can participate in the artistic activities, but the account management, recording of productions, and use of monitoring features must be done by responsible adults, family members, educators, or professionals and facilitators.

3. Personal Data That May Be Processed

Arte Conecta may process the following categories of data, depending on the features used.

3.1. Registration and Contact Data

  • email address;

  • phone number, when requested;

  • credentials and authentication information;

  • affiliation with a school, institution, or organization;

3.2. Profile and Onboarding Responses

May include responses provided during registration or the initial introduction to the platform, such as:

  • relationship with the child or adolescent;

  • family, educational, or professional context;

  • interests;

  • purposes for using the platform;

  • content or monitoring preferences.

3.3. Technical and Usage Data

May include:

  • IP address;

  • date and time of access;

  • device type;

  • operating system;

  • browser;

  • technical identifiers;

  • access logs;

  • pages and features used;

  • interactions with content and activities;

  • information about errors, performance, and security.

3.4. Photographs and Records of Artistic Productions

May include:

  • photographs of drawings, paintings, collages, sculptures, or other artistic productions;

  • records of the artistic process;

  • materials and techniques used;

  • titles, descriptions, observations, and comments;

  • information entered by the responsible adult;

  • results and suggestions generated by Arte Observa IA.

The artistic works belong to their respective authors or copyright holders. The technical processing of this content by Arte Conecta does not transfer ownership.

The responsible adult should avoid sending photos of a child or adolescent's face, full name, address, location, school, or other identifying information unless necessary for the activity.

3.5. Communication and support data

They may include:

  • messages;

  • doubts;

  • requests;

  • complaints;

  • responses to surveys;

  • service records;

  • communications maintained with Arte Conecta.

3.6. Payment-related data

When a paid plan is contracted, data related to the transaction may be processed, such as:

  • plan contracted;

  • value;

  • payment status;

  • date of hiring;

  • renewal;

  • cancellation;

  • transaction identifiers.

Complete card details or other payment instrument information may be processed directly by the app store or the responsible payment provider, according to their own terms and policies.

3.7. Cookies and similar technologies

The website and app may use cookies, pixels, local storage, device identifiers, and similar technologies to:

  • to allow the platform to function;

  • maintain the user session;

  • Protect accounts and prevent fraud;

  • Remember preferences;

  • to understand how to use the service;

When required by law, non-essential technologies will depend on the user's prior choice.

  • record and organize artistic productions;

  • provide Arte Observa IA;

  • generate artistic-pedagogical suggestions;

  • process payments and manage subscriptions;

  • provide support and respond to requests;

  • send service-related communications;

  • send institutional or promotional communications, where permitted;

  • protect accounts, users, and the platform;

  • prevent fraud, abuse, and security incidents;

  • diagnose errors and improve performance;

  • develop and enhance features;

  • comply with legal or regulatory obligations;

  • exercise or defend rights in judicial, administrative, or arbitration proceedings;

  • comply with orders issued by competent authorities.

Data will not be used in a manner incompatible with the purposes communicated to the data subject.

Depending on the purpose and context, Arte Conecta may rely on the following legal bases provided for under the LGPD:

Where processing depends on consent, the data subject may withdraw it through the available channels, without affecting the lawfulness of processing carried out before such withdrawal.

Withdrawal of consent will not prevent data from being retained where another legal basis authorizes or requires such retention.

7. Arte Observa IA

Arte Observa IA performs an artistic-pedagogical analysis of artistic productions submitted by the adult user.

The feature may observe aspects such as:

  • shapes;

  • colors;

  • composition;

  • materials;

  • techniques;

  • elements of the expressive process.

Arte Observa IA may also generate artistic-pedagogical suggestions and recommend Arte Conecta proposals, activities, or learning paths.

To provide this feature, Arte Conecta may process:

  • the image or record submitted;

  • associated information and observations;

  • technical instructions required for processing;

  • the generated result;

  • technical information related to security and operation.

Arte Observa IA:

  • does not provide medical, psychological, or therapeutic diagnoses;

  • is not a clinical assessment tool;

  • does not replace the assessment of family members, educators, or qualified professionals;

  • does not automatically infer the emotions or emotional states of children or adolescents from an image;

  • should not be used as the sole basis for clinical, therapeutic, educational, or rights-affecting decisions.

Results generated by artificial intelligence may contain inaccuracies, omissions, or suggestions that are inappropriate for the specific context. The adult user must critically review them before use.

8. Data Sharing and Processors

Arte Conecta may share personal data, to the extent necessary, with service providers that support the operation of the platform, including providers of:

  • hosting and cloud infrastructure;

  • storage and databases;

  • authentication and account management;

  • payment processing;

  • support and communications;

  • security and fraud prevention;

  • performance and usage analytics;

  • messaging services;

  • artificial intelligence processing.

These service providers may act as data processors, processing data in accordance with Arte Conecta’s instructions, contractual obligations, and applicable law.

Data may also be shared:

  • with public authorities, where required by law or pursuant to a valid order;

  • to exercise or defend legal rights;

  • with other data controllers, where necessary and permitted by law;

Arte Conecta does not sell personal data.

Deletion of an account or content may not result in the immediate removal of temporary copies or backups, which will be deleted in accordance with applicable technical cycles, subject to legally permitted retention requirements.

  • information about the possibility of refusing consent and the consequences of doing so;

  • withdrawal of consent;

  • objection to processing carried out in violation of the LGPD;

  • review of decisions made solely on the basis of automated processing that affect the data subject’s interests;

  • submission of a complaint to the ANPD or consumer protection authorities.

To protect the account and personal data, Arte Conecta may request reasonable information to confirm the identity of the requester or their authority to act on behalf of the data subject.

13. Children and Adolescents

Arte Conecta accounts are intended for adult users aged 18 or older.

Children and adolescents may participate in the artistic activities, but the submission of artistic productions and the use of recording and monitoring features must be carried out by the responsible adult.

The processing of data relating to children and adolescents will be carried out in their best interests.

Where required under the LGPD, the processing of children’s data will depend on the specific and prominent consent of at least one parent or legal guardian.

Arte Conecta will seek to limit data collection to the minimum necessary and provide information in a simple, clear, and accessible manner.

The responsible adult must:

  • have the appropriate authority and authorization to submit the data;

  • avoid providing unnecessary identifying information;

  • assess whether the content is appropriate for submission;

  • supervise the use of results and recommendations;

  • not use Arte Observa IA as a clinical, psychological, or therapeutic tool.

The legal guardian may request access to, correction of, or deletion of the child’s or adolescent’s data through the channels indicated in this Policy.

14. Communications

Arte Conecta may send communications necessary for the operation of the service, including messages regarding:

  • account;

  • security;

  • support;

  • relevant changes;

  • payments;

  • subscribed features.

Promotional communications will be sent in accordance with applicable law. The user may unsubscribe from such communications through the mechanism indicated in the message itself or through the contact channel.

15. Third-Party Links and Services

The platform may contain links to or integrations with third-party services.

These third parties have their own privacy policies and are responsible for the processing activities they carry out independently.
